    2. Standard work day is 9am to 5pm unless specified in writing. We will do our best to accommodate requests outside of those hours. Service outside of standard hours may come with additional charges.

      1. Additional labor

Change orders are billed at $104/hr in 30-minute increments, plus a 20% markup on any third-party services, subcontractors, rentals, permits, disposal fees, or materials required to complete the requested work.

    5. Change orders may be requested and approved through electronic communication including text message, phone call, or email. Client authorizes Contractor to rely upon communications from the Client, property owner, property manager, authorized representative, or any individual reasonably appearing to have authority over the project.

    6. Once approved by the Contractor and work has commenced or been completed, the change order shall become part of the original signed estimate and shall be subject to all terms, conditions, payment obligations, limitations of liability, and collection provisions contained therein. A separate signed document shall not be required for enforceability.

      2. Verbal authorization

      3. Requesting additional work on-site

      6. Partial or full payment toward additional work

    8. If Contractor reasonably believes authorization has been provided by an authorized party or representative at the property, Contractor may proceed with the requested work and invoice accordingly.

  16. Residential Cancellation / Rescheduling Policy / Material Reductions in Scope of Work

    1. Client understands that once an estimate or scope of work is approved, Metri Power Washing reserves labor, equipment, materials, scheduling capacity, and production time for the project. Because our schedule is limited and cancelled work often cannot be replaced on short notice, cancellations may result in a cancellation charge as described below.

    2. Rescheduling with at least 72 hours’ notice: No cancellation charge, provided the project is rescheduled to a mutually agreed date within 14 days. If the project is not rescheduled within 14 days, or if the client reschedules more than 2 times, the request may be treated as a cancellation.

    3. After any legally required cancellation period has expired, the following cancellation charges apply:

      1. Cancellation more than 14 days before scheduled start date: Client is responsible for nonrecoverable expenses including but not limited to job related travel, estimation, project management, and administrative time to be billed at $105/hour.

      2. Cancellation 8-14 days before the scheduled start date: Client is responsible for 20% of the cancelled or materially reduced scope value.

      3. Cancellation 3 to 7 days before the scheduled start date: Client is responsible for 40% of the cancelled or materially reduced scope value.

      4. Cancellation less than 72 hours before the scheduled start date: Client is responsible for 50% of the cancelled or materially reduced scope value.

      5. Cancellation on the scheduled service date, refusal of access, inability to perform due to client-controlled conditions, cancellation after crews or equipment have been dispatched, or cancellation once work has already begun: Client is responsible for 60% of the cancelled or materially reduced scope value.

      6. If work on a project has begun and there is a material reduction in the scope of work or cancellation of the project. The client is responsible for the full cost of work performed up until that point and 60% of the cancelled or materially reduced scope value.

    4. A material reduction in scope of work means a reduction, removal, delay, or cancellation of 20% or more of the approved quoted value, including removal of one or more approved services, areas, phases, or line items. Reductions below 20% may still require a written change order and may result in revised pricing if the original estimate was based on bundled services, minimum charges, mobilization costs, or other project efficiencies. In these circumstances a new signature is not required to perform the revised scope of work.

    5. Any cancellation charge is intended as a reasonable estimate of Metri Power Washing’s damages, including reserved schedule capacity, administrative time, site planning, labor planning, equipment allocation, lost opportunity to schedule other work, and other costs incurred. It is not a penalty.

    6. Any deposits or payments already made will be applied toward the applicable cancellation charge. If the cancellation charge exceeds amounts already paid, the remaining balance will be invoiced and due according to the payment terms in this agreement.

    7. Costs for special-order materials, equipment rentals, lift reservations, water access arrangements, permits, traffic control, insurance endorsements, subcontractor commitments, disposal fees, site-specific compliance requirements, or other project-specific expenses incurred before cancellation are the client’s responsibility in addition to any applicable cancellation charge, unless those costs are already included in the cancellation amount. These charges may carry a standard mark up of 20%.

    8. For multi-day, recurring, phased, seasonal, or contract-based residential work, cancellation of any approved phase, scheduled service, or remaining portion of the project may be treated as cancellation of the applicable outstanding quoted value for that phase, service, or remaining work.

    9. Weather delays, unsafe working conditions, or delays caused by Metri Power Washing do not constitute client cancellation. In those cases, the project will be rescheduled to the next mutually available date.

    10. For residential home improvement contracts where a statutory right of cancellation applies, the client may cancel without penalty within the legally required cancellation period. This policy applies only after any legally required cancellation period has expired, or where no statutory cancellation period applies.

  17. Commercial Cancellation / Rescheduling Policy

    1. Client understands that once an estimate, proposal, purchase order, or scope of work is approved, Metri Power Washing reserves labor, equipment, materials, scheduling capacity, production time, and operational resources for the project. Commercial projects often require advance planning, coordination, staffing, equipment allocation, insurance compliance, vendor coordination, and the rejection or delay of other revenue-producing work. Because cancelled commercial work often cannot be replaced on short notice, cancellations may result in a cancellation charge as described below.

    2. Rescheduling with at least 7 days’ notice: No cancellation charge, provided the project is rescheduled to a mutually agreed date within 30 days. If the project is not rescheduled within 30 days, or if the client reschedules more than 2 times, the request may be treated as a cancellation.

    3. The following cancellation charges apply to commercial projects:

      1. Cancellation more than 14 days before scheduled start date: Client is responsible for nonrecoverable expenses including but not limited to job related travel, estimation, project management, and administrative time to be billed at $105/hour.

      2. Cancellation 8-14 days before the scheduled start date: Client is responsible for 25% of the cancelled or material removed scope value.

      3. Cancellation 3 to 7 days before the scheduled start date: Client is responsible for 45% of the cancelled or material removed scope value.

      4. Cancellation less than 72 hours before the scheduled start date: Client is responsible for 60% of the cancelled or material removed scope value.

      5. Cancellation on the scheduled service date, refusal of access, inability to perform due to client-controlled conditions, cancellation after crews or equipment have been dispatched, or cancellation once work has already begun: Client is responsible for 70% of the cancelled or removed scope value.

      6. Cancellation on the scheduled service date, refusal of access, inability to perform due to client-controlled conditions, cancellation after crews or equipment have been dispatched, cancellation once work has already begun, or cancellation after project-specific labor, equipment, subcontractors, permits, insurance endorsements, or rentals have been committed: Client is responsible for 70% of the canceled or materially reduced project scope.

    6. Any deposits, mobilization fees, or payments already made will be applied toward the applicable cancellation charge.

    8. For multi-day, recurring, phased, seasonal, or contract-based commercial work, cancellation of any approved phase, scheduled service, or remaining portion of the project may be treated as cancellation of the applicable outstanding quoted value for that phase, service, or remaining work.

    9. Weather delays, unsafe working conditions, regulatory restrictions, or delays caused by Metri Power Washing do not constitute client cancellation. In those cases, the project will be rescheduled to the next mutually available date.

  18. Annual/Seasonal Commitments

    1. Seasonal pricing assumes full-season commitment.

    2. Early cancellation may forfeit the deposit.

    3. No credits if the client hires an alternate contractor during the term.

    4. Service slots are reserved in advance.

  19. Subcontractors and Third-Party Vendors

Addendum: Snow & Ice Management

This Addendum applies to all snow removal and de-icing services provided by Metri Power Washing (“Contractor”) and shall be read together with the existing Terms & Conditions. This Addendum governs for snow and ice services only. All terms below apply unless otherwise agreed to in writing.

  1. Seasonal Contracts

    1. Seasonal contracts provide service coverage for the specified property during the season, November through March, unless otherwise stated in writing.

    2. Seasonal pricing includes routine service visits as outlined in the contract (e.g., plowing, shoveling, de-icing).

    3. Services outside of the agreed scope (such as hauling/removal of snow piles, ice-dam remediation, or emergency calls beyond contract coverage) will be billed separately.

    4. Bundled service packages (e.g., “6 plowings plus 1 free”) are valid only for the contracted season. Any unused services expire at the end of the season and are not transferable, refundable, or credited toward the following winter.

  2.  Trigger Depth & Service Response

    1. A snow event is considered to have occurred when snowfall reaches a depth of two (2) inches, unless otherwise stated in writing. For accumulations of less than two inches, the Contractor is not obligated to perform service. Snow management pricing applies to events producing up to two (2) inches of accumulation. For accumulations greater than two (2) inches, pricing will increase by twelve percent (12%) for each additional inch, compounded.

    2. For snow accumulation of less than 2 inches, Contractor will be on a call basis for snow and ice management, Contractor will not be held liable for any slip and falls during these events.

    3. An ice event is considered to have occurred or is reasonably suspected to occur when conditions create a reasonable risk of ice accumulation on driving or walking surfaces. This includes but is not limited to forecasted precipitation in the next 24 hours. The Contractor reserves the right to determine when salting or de-icing is necessary to maintain safe conditions, including proactive deicing applications. Client may request additional de-icing services at any time, billed at the standard rate.

    4. The Contractor will dispatch crews in a timely manner, subject to weather and safety conditions. Exact timing cannot be guaranteed. Client remains solely responsible for compliance with municipal or HOA ordinances including fines, penalties, or enforcement actions. Contractor will provide timely service but cannot guarantee avoidance of fines or penalties.

    5. Storms producing ten (10) inches or more of snow in a single event are subject to additional charges, regardless of seasonal contracts or bundled pricing. These charges reflect the increased time, labor, and equipment required to manage heavy accumulations. Contractor will communicate applicable rates prior to or during service.

  3.  Surface & Property Conditions

    1. Client acknowledges that snow and ice management techniques can scrape, scuff, or otherwise affect paved and landscaped surfaces. Contractor is not responsible for damage to surfaces already cracked, deteriorated, or not designed for snow equipment.

    2. Snow will be pushed to designated areas on the property unless otherwise directed in writing. Snow hauling or off-site removal is not included unless specifically contracted.

  4.  Hazard Marking

    1. Contractor is not responsible for damage caused by hidden or unmarked objects in the service area (e.g., extension cords, landscaping features, curbs, speed bumps, utility fixtures). Prior to the start of the season, Contractor will install high-visibility stakes on the property to mark hazards at the standard outing rate plus $1.30 per stake installed. The Client shall inspect the placement of stakes upon installation and has until the first ground freeze of the season to notify Contractor in writing of any objections or required adjustments. If no notice is received within that time, the stakes shall be deemed approved by the Client. After this point, the Client assumes full responsibility for identifying any additional hazards and agrees to indemnify and hold Contractor harmless from claims, damages, or liability arising from unmarked or hidden obstacles, including but not limited to curbs, landscaping, or utility fixtures.

  5.  De-Icing/Pre-Salting

    1. Contractor may apply rock salt, calcium chloride, or other de-icing products at its discretion, unless otherwise specified in writing.

    2. Client understands that these products may have effects on vegetation, concrete, asphalt, or other surfaces, and Contractor is not liable for these effects.

    3. Contractor is not responsible for cracking, spalling, or deterioration of asphalt or concrete surfaces due to freeze-thaw cycles, pre-existing defects, reasonable use of plowing, shoveling, snowblowing, or use of de-icing agents.

    4. Contractor is not responsible for refreeze conditions unless expressly notified and dispatched for service with reasonable time to respond. Client assumes responsibility for monitoring and reporting refreeze.

  6.  Term & Termination

    1. Seasonal contracts are prepaid in full or according to the agreed payment schedule.

    2. Per event contracts are invoiced upon completion of service and payment is due upon receipt of invoice.

    3. Contracts are non-refundable once the season begins, regardless of actual snowfall, unless otherwise stated in writing.

    4.  Extreme Weather

  7. Contractor is not liable for delays or inability to perform services due to extreme weather conditions, road closures, equipment breakdown, or events beyond Contractor’s control including but not limited to extreme snowfall rates exceeding service capacity, freezing rain events, or government-imposed restrictions..

  8.  Hold Harmless/ Indemnification Clause

    1. The Client acknowledges that snow and ice management services reduce, but do not eliminate, the risk of slippery conditions. The Contractor makes no guarantee that surfaces will be completely free of snow or ice at any time. By signing this agreement, the Client agrees to indemnify, defend, and hold harmless the Contractor, its employees, and subcontractors from and against any and all claims, damages, liabilities, costs, or expenses (including attorney’s fees) arising from or related to slip-and-fall incidents or other injuries allegedly caused by snow or ice on the Client’s property, except in cases of gross negligence or willful misconduct by the Contractor.

    2. In the event the Client directs the Contractor not to provide service, or elects to limit service to certain areas, the Client assumes full responsibility for any resulting conditions and agrees to release the Contractor from all liability associated with such decision.

    3. Contractor is not liable for damages, claims, or injuries arising from ordinary negligence in the performance of snow and ice management services. Services are intended to reduce, but not eliminate, hazardous conditions. Client accepts that residual snow or ice may remain on serviced surfaces.

  9.  Property Condition

    1. Client acknowledges that certain paved or hardscape surfaces may contain irregularities including, but not limited to, potholes, heaving, settlement, loose aggregate, exposed stone, deteriorated asphalt or concrete, raised utility covers, cracked pavement, damaged curbing, uneven transitions, or other surface defects.

    2. Where such conditions exist, Contractor reserves the right, in Contractor’s sole discretion, to modify plowing techniques in order to reduce the risk of damage to equipment and to prevent further deterioration of the surface. This may include, but is not limited to:

      1. Raising plow blades or altering equipment settings

      2. Adjusting service patterns

      3. Avoiding specific areas deemed unsafe

      4. Maintaining a protective layer of snow of up to approximately two (2) inches on paved surfaces

    3. The maintenance of a protective snow layer under these conditions shall not constitute incomplete performance, breach of contract, or grounds for withholding payment.

    4. Contractor shall not be responsible for damage to pavement, curbing, pavers, concrete, asphalt, or other hardscape surfaces that are cracked, deteriorated, uneven, structurally compromised, or otherwise defective prior to service.

    5. Deicing materials may be applied over remaining snow at Contractor’s discretion to maintain reasonable access and reduce hazardous conditions; however, Contractor does not guarantee bare pavement where surface conditions prevent safe scraping.

Addendum: Paver Cleaning & Maintenance

This Addendum applies whenever the contracted work includes cleaning or power washing pavers, replacing joint sand, applying paver sealer, leveling or resetting pavers, or performing related paver maintenance. If this Addendum conflicts with the Contractor’s general Terms and Conditions, this Addendum will control only with respect to the paver-related services.

  1. General Nature of Paver Maintenance

    1. Client understands that pavers, jointing materials, sealers, bedding material, base material, edge restraints, drainage systems, and surrounding landscaping function together as a system. Cleaning, sanding, sealing, or limited leveling is considered maintenance and does not constitute reconstruction of the entire paver system unless full reconstruction is expressly included in the written scope of work.

    2. Contractor’s services are limited to the specific areas and services identified in the estimate. Services not expressly listed are excluded.

  2. Paver Power Washing and Cleaning

    1. Includes

      1. Paver power washing or cleaning includes:

      2. Application of an appropriate cleaning solution when included in the estimate.

      3. Pressure washing, surface cleaning, or low-pressure rinsing using methods selected by Contractor.

      4. Removal of ordinary surface dirt, organic growth, loose debris, and deteriorated or loose joint sand.

      5. Reasonable rinsing of the work area.

      6. Reasonable protection and cleanup associated with the contracted work.

      7. Post-treatment for remaining organic growth when specifically included.

    2. Does Not Include

      1. Unless specifically listed in the estimate, paver cleaning does not include:

      2. Complete stripping or removal of previously applied sealer, coatings, paints, adhesives, or curing compounds.

      3. Guaranteed removal of oil, grease, rust, fertilizer stains, leaf or tannin stains, efflorescence, mineral deposits, tire marks, paint, mortar, gum, irrigation stains, or other deeply absorbed discoloration.

      4. Restoration of faded, weathered, oxidized, chemically damaged, etched, worn, or permanently stained pavers.

      5. Repair of cracked, chipped, spalled, loose, sinking, heaving, or damaged pavers.

      6. Correction of drainage, grading, base failure, edge-restraint failure, erosion, or structural settlement.

      7. Cleaning of areas not reasonably accessible with Contractor’s normal equipment.

      8. Protection or restoration of adjacent items that Client was responsible for removing or disclosing.

    3. Client understands that cleaning may reveal preexisting discoloration, repairs, efflorescence, fading, aggregate exposure, worn coatings, inconsistent previous sealing, or other conditions that were concealed by dirt or organic growth.

    4. Some joint sand may be removed during proper cleaning. Replacement is included only when joint sand installation is specifically listed in the estimate.

  3. Joint Sand Replacement

    1. Includes

      1. Joint sand replacement includes, as stated in the estimate:

      2. Removal of loose, contaminated, deteriorated, or existing joint material to a reasonably achievable depth.

      3. Removal of weeds or loose organic material present within accessible joints.

      4. Drying and preparation of the paver surface to the extent reasonably achievable.

      5. Installation of the specified polymeric sand, jointing sand, or other approved joint material.

    2. Does Not Include

      1. Unless specifically stated, joint sand replacement does not include:

      2. Complete excavation of every joint to the bedding layer.

      3. Removal of cementitious grout, mortar, epoxy, resin joint material, or unusually hard existing material.

      4. Rebuilding failed bedding or base materials.

      5. Correcting improper joint widths, unusually tight joints, excessively wide joints, false joints, or paver designs incompatible with the selected sand.

      6. Repair or replacement of damaged pavers or edge restraints.

      7. Elimination of all weeds, moss, ants, insects, or future biological growth.

      8. A guarantee that sand will not settle, crack, erode, wash out, loosen, discolor, or require future maintenance.

      9. Correction of runoff, downspout discharge, erosion, vehicle movement, snowplow damage, pressure washing by others, or other conditions that may remove joint material.

    3. Polymeric sand and other jointing products reduce joint erosion and weed growth but do not permanently prevent weeds, insects, settlement, or washout. Weeds may germinate from seeds deposited above the joint, and joint material may be affected by water movement, freeze-thaw cycles, traffic, improper drainage, or movement within the paver system.

    4. Joint sand color may vary from samples, packaging, photographs, previously installed material, or adjacent areas. Differences in joint depth, moisture, compaction, aging, residue, and surrounding paver color may affect the final appearance.

  4. Paver Sealer Application

    1. Includes

      1. Paver sealing includes only the following when identified in the estimate:

      2. Evaluation of the visibly accessible surface before application.

      3. Reasonable preparation of the paver surface.

      4. Application of the specified sealer using the number of coats or application rate stated in the estimate.

      5. Application according to the manufacturer’s instructions and Contractor’s professional judgment.

      6. Reasonable protection of adjacent surfaces.

      7. Restriction of traffic during the applicable curing period.

    2. The selected sealer may enhance color, alter sheen, stabilize compatible joint sand, and provide limited resistance to water penetration and staining. Sealer is a maintenance coating and not a permanent or waterproof surface.

    3. Does Not Include

      1. Unless expressly included, sealing does not include:

      2. Removal or stripping of existing sealer.

      3. Identification of the manufacturer or chemical composition of an unknown existing sealer.

      4. Guaranteed compatibility with an undisclosed or unidentified previous coating.

      5. Correction of moisture vapor transmission, groundwater, hydrostatic pressure, drainage, grading, or water trapped beneath the pavers.

      6. Guaranteed prevention of stains, weeds, fading, efflorescence, mold, moss, algae, erosion, sand loss, tire marking, scratches, chemical damage, or freeze-thaw damage.

      7. A guaranteed exact color, shade, gloss level, wet look, or completely uniform appearance.

      8. Repair of existing paver damage, coating failure, efflorescence, mineral staining, oxidation, fading, or differences between replacement and original pavers.

      9. Future maintenance coats, stripping, solvent washing, repairs, or recoating unless specifically included.

  5. Sealer Appearance and Color Variations

    1. Client understands that sealer appearance is affected by conditions beyond Contractor’s control, including:

      1. Paver age, porosity, density, texture, color variation, wear, and manufacturing differences.

      2. Previous sealers, coatings, cleaners, acids, salts, fertilizers, chemicals, or repairs.

      3. Uneven absorption or differing moisture levels within the pavers and bedding system.

      4. Shade, direct sunlight, tree coverage, temperature, humidity, wind, and curing speed.

      5. Tree sap, pollen, fruit, leaves, tannins, bird droppings, soil, irrigation water, and organic debris.

      6. Vehicle traffic, tire compounds, furniture, planters, grills, rugs, snow-removal equipment, and deicing products.

      7. Efflorescence, mineral migration, underground moisture, and water entering from adjoining areas.

    2. Tree-covered and shaded areas may retain moisture longer, cure differently, collect organic material, or develop a different color or sheen than areas receiving greater sunlight. These differences do not necessarily indicate improper application.

    3. Contractor may perform a sample area when practical, but Client understands that a sample does not guarantee that the entire project will develop the same color or sheen.

  6. Drainage, Moisture, Haziness, Whitening and Blushing

    1. Client acknowledges that Contractor does not design, install, inspect, or warrant the property’s drainage system unless drainage work is specifically included in the written scope.

    2. Poor drainage, low areas, improperly pitched pavers, saturated bedding, failed base material, irrigation, downspout discharge, groundwater, subsurface moisture, water entering from adjoining surfaces, and prolonged tree shade may cause water to remain on or beneath the pavers.

    3.  Moisture may contribute to:

      1. Milky, cloudy, white, hazy, or blotchy areas.

      2. Sealer blushing or whitening.

      3. Uneven color enhancement or sheen.

      4. Delamination, peeling, bubbling, or coating failure.

      5. Efflorescence or mineral deposits.

      6. Joint sand deterioration or washout.

      7. Recurring organic growth.

    4. Contractor will use reasonable care to evaluate visible surface conditions and follow appropriate application procedures. However, Contractor cannot determine or control all subsurface moisture, drainage, previous coating, weather, landscaping, or environmental conditions.

    5. Haziness, whitening, blushing, discoloration, or coating failure caused or contributed to by poor drainage, subsurface moisture, irrigation, downspouts, tree coverage, persistent shade, unexpected precipitation, preexisting coatings, efflorescence, or other conditions outside Contractor’s workmanship are not covered by any workmanship warranty.

    6. Corrective work may involve solvent treatment, additional cleaning, removal of sealer, stripping, drying, re-sanding, drainage correction, or reapplication. Such corrective work is not included in the original price and may be offered under a separate estimate or written change order.

  7. Existing Sealer and Unknown Coatings

    1. Client must disclose any known previous sealer, coating, paint, stain, curing compound, or chemical treatment applied to the pavers.

    2. When the existing product is unknown, Contractor cannot guarantee compatibility between the existing coating and the proposed sealer. Cleaning does not necessarily remove all previous coating material.

    3. Contractor may recommend testing, stripping, changing products, or declining to seal the surface. Testing reduces risk but does not guarantee compatibility across the entire area. Failure caused by an undisclosed, unidentified, deteriorated, incompatible, or improperly applied previous coating is not covered by Contractor’s workmanship warranty.

  8. Leveling and Resetting Uneven Pavers

    1. Includes - Limited paver leveling includes only the areas identified in the estimate and may include:

      1. Lifting designated pavers.

      2. Removing or adjusting accessible bedding material.

      3. Adding and grading replacement bedding material.

      4. Resetting existing pavers to improve alignment with surrounding pavers.

      5. Replacing joint sand in the repaired area when included.

      6. Minor adjustment of adjacent pavers when reasonably necessary to complete the repair.

    2. The purpose of limited leveling is to improve the designated condition. It does not guarantee that the repaired surface will be perfectly flat or meet the tolerances of a newly constructed paver installation.

    3. Does Not Include - Unless specifically stated, leveling does not include:

      1. Full excavation or reconstruction of the paver base or subbase.

      2. Correction of improper grading, drainage, soil movement, erosion, washout, or unstable ground.

      3. Tree or root removal.

      4. Relocation or repair of utilities, irrigation, electrical lines, plumbing, drains, foundations, or buried structures.

      5. Replacement of cracked, chipped, stained, warped, discontinued, or unavailable pavers.

      6. Repair or replacement of edge restraints, steps, retaining walls, curbing, concrete, or adjoining structures.

      7. Engineering, surveying, drainage design, or structural evaluation.

      8. A guarantee against future settlement, frost heaving, root movement, erosion, or recurrence of unevenness.

    4. Existing pavers may be brittle, bonded together, previously glued, pinned, mortared, or damaged below the visible surface. Contractor will use reasonable care, but hidden deterioration or construction methods may prevent removal or cause pavers to crack during lifting. Replacement materials and additional labor will be charged separately when the condition was not reasonably visible before work began.

    5. Color and texture differences between existing and replacement pavers are expected and are not considered defective workmanship.

  9. Concealed or Unforeseen Conditions - The estimate is based on conditions reasonably visible before work begins. Conditions that may not be visible until cleaning, sand removal, sealer testing, excavation, or lifting pavers begins include:

    1. Failed or missing base material.

    2. Excessively deep joints.

    3. Concrete, mortar, adhesive, pins, or other restraints beneath the pavers.

    4. Buried utilities or irrigation.

    5. Root intrusion.

    6. Improper bedding material.

    7. Extensive settlement or erosion.

    8. Broken or deteriorated pavers.

    9. Multiple incompatible layers of sealer.

    10. Trapped moisture or hidden drainage problems.

      1. Contractor may stop work when an unforeseen condition affects safety, product compatibility, workmanship, cost, or the ability to complete the original scope. Additional work will require Client authorization through a written change order or separate estimate.

  10. Weather and Scheduling

    1. Paver cleaning, joint sand installation, sealing, and curing depend on suitable weather and surface conditions. Contractor may postpone or interrupt work because of rain, temperature, humidity, wind, saturated pavers, wet joints, extended shade, or other conditions that could affect the work.

    2. Estimated scheduling and completion dates may change as a result. Weather-related postponements do not constitute abandonment or nonperformance.

    3. Client must follow all instructions regarding irrigation shutoff, foot traffic, vehicle traffic, furniture placement, pets, landscaping, and cure time. Damage or appearance changes caused by traffic, water, irrigation, rainwater discharge, landscaping, debris, animals, furniture, or use of the area before the stated cure period ends are not covered.

  11. Client Responsibilities

    1. Before work begins, Client shall:

      1. Remove furniture, rugs, planters, grills, decorations, toys, vehicles, hoses, and other movable items unless moving services are included.

      2. Disclose known drainage problems, underground utilities, irrigation components, loose pavers, previous repairs, existing sealers, and chemical treatments.

      3. Turn off irrigation systems as directed.

      4. Keep people, pets, vehicles, and other contractors away from the work area.

      5. Prevent landscapers, irrigation systems, cleaners, or other trades from disturbing the area during preparation and curing.

      6. Follow all post-service maintenance and cure instructions.

    2. Moving, protecting, removing, reinstalling, or repairing items not included in the estimate may result in additional charges.

  12. Warranty Limitations and Maintenance

    1. Any workmanship warranty applies only when expressly stated in writing and covers only defects directly caused by Contractor’s failure to perform the contracted service in a reasonably workmanlike manner.

      1. Unless expressly stated otherwise, warranties do not cover:

        1. Drainage, grading, subsurface moisture, base failure, settlement, frost movement, erosion, or root growth.

        2. Tree coverage, shade, sap, leaves, tannins, pollen, fruit, or other organic deposits.

        3. Blushing, whitening, haziness, efflorescence, or discoloration arising from moisture or preexisting conditions.

        4. Previously installed sealers, coatings, joint materials, pavers, bedding, bases, edge restraints, or drainage systems.

        5. Normal wear, weathering, fading, loss of sheen, traffic, tire marks, scratches, stains, deicing salts, snow removal, chemicals, or misuse.

        6. Weed or insect growth.

        7. Sand loss caused by runoff, pressure washing, drainage, traffic, animals, or maintenance by others.

        8. Damage caused by Client, occupants, tenants, visitors, landscapers, snow-removal contractors, or other service providers.

    2. Corrective services for excluded conditions will be separately billable. Nothing in this Addendum limits any right or remedy that cannot legally be waived.
